Terms of Service

Terms of Service

Please read these terms carefully before using our services.

1.0 General

These terms govern the relationship between the Customer and SpillHosting AS regarding the purchase/rental of services from SpillHosting AS. The agreement is entered into when the Customer has placed an order. This can occur via phone, web, email, written, or verbal communication.

2.0 Parties

Seller: Company Name: SpillHosting AS, Contact Address: Keilevegen 174 A, 5953 Fonnes, Email: [email protected], Org Number: NO928684792MVA. The Customer is the person who places the order.

3.0 Price

The price quoted for the goods and services is the total price to be paid by the buyer. This price includes all fees and additional costs. Additional costs that the seller has not informed before the purchase do not bear the buyer. Exceptions: All customers outside of Norway are charged with 0% VAT due to export of services. The sale prices seen in the webshop include this VAT rate of 0%. Customers with address in Norway will be charged additional 25% of the sale price seen in the webshop.

4.0 Contact Information

The Seller assumes that the person listed as the recipient of the email, as well as those with the account password, are authorized to manage products/services. The Customer is obligated to update contact information in the control panel or notify the Seller of changes.

5.0 Payment

The Seller may require payment for the service from the time the order is created by the Customer. The Customer can choose to pay with Vipps, Stripe, or PayPal.

6.0 Delivery

Delivery is considered complete when the Customer or their representative has access to the service. The Seller must deliver the service to the Customer without undue delay and no later than 30 days after the Customer's order.

7.0 Termination

Upon termination or transfer of services, it is the Customer's responsibility to retrieve all data stored with the Seller before the end of the Agreement period. Upon termination of services, all Customer data will be deleted.

8.0 Breach

If the Customer significantly breaches all or part of their obligations to the Seller, the Seller has the right to terminate existing agreement(s) with immediate effect.

9.0 Changes

The Seller reserves the right to make updates and/or upgrades and adjustments to products and services provided by the Seller. Significant changes to the terms must be notified to the Customer with at least 14 days' notice.

10.0 Late Payment

In the event of late payment of an invoice, a late fee of 10 kroner per day will be applied after the due date. If the invoice is overdue, the associated services will be temporarily suspended.

11.0 Right of Withdrawal

If the Customer has not used the service, i.e., not started the game server, the Customer has 14 days to exercise the right of withdrawal. We also offer all new customers a 24-hour money back guarantee. The right of withdrawal and the money back guarantee do not apply to domain name registrations, renewals, or transfers, as these are executed immediately with the domain registry at the Customer's request and cannot be reversed. A refund under the 24-hour money back guarantee is the amount paid minus the payment provider's transaction fee, which the provider does not return to us.

12.0 Service Defects - Customer's Rights and Complaint Deadline

If there is a defect in the service, the Customer must notify the Seller within a reasonable time after it was discovered or should have been discovered, that they wish to invoke the defect.

13.0 Dispute Resolution

Complaints should be directed to the Seller within a reasonable time. The parties should attempt to resolve any disputes amicably. If this is not successful, the Customer may contact the Consumer Complaints Board.

Acceptable Use

The Customer may only use the services for lawful purposes. It is not permitted to use the services to store, distribute or give access to material that infringes copyright or other rights, including P2P file sharing of such material, to send spam, to carry out port scans, attacks or DDoS against other networks, or to host malware, phishing or fraud. The Customer is responsible for all traffic and content from their services, including traffic from users the Customer gives access to. If the Seller receives an abuse report or discovers a breach, the Seller may suspend the service immediately without prior notice. Serious or repeated breaches count as a significant breach under section 8.0, and the agreement may be terminated with immediate effect without a refund for the remaining period.

Terms for Game Servers

This agreement governs the relationship between the Seller and the Customer for game servers. A 99.9% uptime is guaranteed for infrastructure such as panels, servers, etc. Game server is a continuous service/subscription billed in advance.

Terms for Dedicated Servers

This agreement governs the relationship between the Seller and the Customer for dedicated servers. A 99.9% uptime is guaranteed for infrastructure. Dedicated Server is a continuous service/subscription billed in advance. The Customer is responsible for the operation of the server.

Terms for VPS

This agreement governs the relationship between the Seller and the Customer for virtual private servers (VPS). A 99.9% uptime is guaranteed for infrastructure. VPS is a continuous service/subscription billed in advance. The Customer has full administrator access and is responsible for the operation and security of the server, including keeping software up to date. Terms for Domain Names

Domain name registrations, renewals, and transfers are submitted to the domain registry immediately upon payment and cannot be reversed. Domain purchases are therefore exempt from the right of withdrawal and the money back guarantee, and are non-refundable once registered. The registered domain belongs to the Customer (the registrant) for the entire paid period. The Customer is responsible for providing accurate and up-to-date registrant contact details, as required by ICANN and the relevant registry, and for paying the renewal invoice before the expiry date. Domains do not renew automatically; an unpaid domain expires and may afterwards only be restorable against an additional redemption fee set by the registry, after which it can be released for registration by anyone. All domain services are additionally subject to the registration terms of the relevant registry.
